Ex-mayor Anthony Russo lawsuit against BoE thrown out


A lawsuit by former mayor and convicted felon Anthony Russo against the Hoboken Board of Education claiming health related damages due to asbestos was dismissed in court late last month.

The suit claimed Russo suffered damages over a three year period when he was a teacher from 1990 – 1993 and attributed cancer due to the removal of asbestos.

The Superior Court of NJ ruled the statute of limitations had passed and dismissed the case noting:
In light of our holding, we need not address Russo’s other arguments regarding the need for expert testimony as to causation. We only add that there is no requirement that the WCJ consider expert testimony before granting a motion to dismiss based on the statute of limitations. See N.J.A.C. 12:235-3.5(c)(“motions shall be disposed of on the papers, unless a Judge of Compensation directs oral argument or further proceedings”).
